Specifications include, but are not limited to:Successful Responders will perform tasks on behalf of participants or their representative who directly employ individual workers to assist participants in fulfilling their state and federal legal obligations as employers. This program is designed with the expectation that the workers of participants will be neither common law nor economic realities test employees of the FMS providers. DHS expects responders to engage with the workers of participants so as not to create a common law or economic realities test employment relationship with the participants' workers. As a VF/EA FMS, successful Responders will also be responsible for making non-routine, non-payroll purchase transactions for goods and vendor services on behalf of CDCS and CSG participant employers. Successful Responders will provide participants of self-directed programs the opportunity to exercise choice and control over services and supports by assisting them in fulfilling certain state and federal obligations as employers of their individual workers, making vendor payments, and performing certain administrative activities on the participants behalf including, but not limited to: 1)Functioning as a statewide VF/EA FMS organization in accordance with Section 3504 of the Internal Revenue Code, and Revenue Procedure Code 2013-39, as applicable: 2)Educating and training participants on: a.contractor policies and procedures related to their responsibilities as a participant employer; and b. their legal obligations as employers of their workers and ensuring that participants are in compliance with all federal and state labor, tax and workers compensation insurance rules, timelines, and regulations for household employers, and have the VF/EA FMS organization prepare payroll and related tasks for their individual workers; 3) Initiating criminal background studies and checking the Office of Inspector General list of excluded individuals and entities;
