Specifications

Specifications include, but are not limited to: 1. City Attorney Services: Designation of attorney to serve as the City Attorney. City prefers that City Attorney designee be a principal, managing partner, equity partner (or similar position) in the submitting firm. Such designation shall be subject to City approval. The City Attorney, or their designee approved by the City, shall represent the City in all legal matters in which the City is a part of or has an interest in or in which any of its officers are parties in their official capacity. The level of involvement of the City Attorney (or approved designee) shall be defined by the Mayor, the City Administrator, or by a majority vote of the Board of Aldermen. The City Administrator shall be the Citys primary contact with the City Attorney. Professional services provided by the City Attorney shall include but are not limited to: General legal counsel and advice General legal services Legal advice on special projects Principal contact between the City and other legal professionals within the selected firm Advice in selection and technical oversight of special counsel when needed Serve as the municipal court prosecutor in the absence of the designed municipal court prosecutor Specific Duties and Responsibilities shall include: The city attorney shall attend all meetings of the Board of Aldermen. Upon request, the City Attorney shall attend meetings of the Board of Aldermens subcommittees or other Subordinate City Boards, Commissions, or Entities. Serve as legal advisor and counsel to Mayor, Board of Aldermen (as a whole), Special Committees, Boards, Commissions and the City Administrator. Provide legal advice and counsel to Department Directors and other City staff as authorized by the City Administrator, Mayor or Board of Aldermen. Upon request, provide guidance on personnel matters, including employee discipline, termination, and grievances. Upon request, draft, review, or present all agreements, bonds, contracts, resolutions, ordinances, staff reports, letters, or other written instruments related to City activities or which will be considered by the Board of Aldermen. Provide a legal opinion relative to the consequences of said documents/associated actions. Provide legal services related to land use including counsel and advice on planning, zoning, variances, board of zoning adjustment procedures, land acquisition, easements, condemnation, annexation, stormwater, and right of ways. Conduct legal research and provide legal opinions on a variety of municipal and general law topics as may be required. Advise Mayor, Board, Committees, and Staff on applicability, relevance and compatibility with federal law, state statutes, municipal code, board procedures and city land use/development and planning documents. Represent the City and elective and appointive officers in any legal and judicial proceedings related to actions or omissions occurring while serving in their official capacities. Advise Mayor, Board, and Staff on need for special counsel, assisting in selection of special counsel, provide technical assistance to Mayor, Board, and Staff in working with or providing oversight of special counsel. Prepare, draft, or review correspondence or legal documents on behalf of the City. Provide general management and technical oversight of other members of firm providing legal service, assistance, advice or duties for the City. Provides legal advice and guidance in the absence or unavailability of the City Prosecutor. Provide for and oversee necessary support staff. 2. City Prosecutor Services: The Perryville Municipal Court is conducted as a division of the Perry County Circuit Court (Missouri 32nd Judicial Circuit Court) and is presided over by an associate circuit court judge. The City anticipates that the City Prosecutor may also serve as City Attorney in absence of the same. Professional services provided by the City Prosecutor/Assistant City Attorney shall include but are not limited to: Representing the City in all municipal court cases. Provide legal advice to Chief of Police and police officers related to violations of state and city criminal codes. Be available to review and sign probable cause statements, warrant requests, bond requests, and other court, detention, and bond documents. Review all citations and summons presented to the municipal court; determines prosecution decision, dismiss summons as needed, signs and forwards valid charges to court clerk. Attends and represents city at all regular municipal court sessions. Attends and represents city at all special arraignment or special municipal court sessions. Provides legal advice and guidance in the absence or unavailability of the City Attorney. Provide for and oversee necessary support staff.
