Specifications include, but are not limited to: rovide appellate representation in the following manner:After receiving notice of an appeal, the Appellate Division will go through the AVL in alphabetical order, and work with selected Providers to ensure they are able to take a case and provide constitutionally mandated effective and timely assistance of counsel on the appeal.Upon notice of assignment to an appeal, Provider shall review the Providers total workload to determine if effective Services can be provided on an assigned case, considering any material conflict of interest.If a Provider refuses to take an appeal, the Appellate Division will move to the next alphabetical Provider. Any Providers refusal to take an appeal will not preclude future appeals being assigned to that Provider.The Provider agrees to maintain current status on the Utah Appellate Roster. Upon expiration of the Providers appointment to the Appellate Roster, the Provider agrees to reapply for appointment to the Appellate Roster--fulfilling the Appellate Rosters eligibility criteria--and shall maintain his/her appointment for inclusion on the Appellate Roster during the entire period of contractual agreement.By taking an appeal, the Provider agrees that s/he has the time, experience, training, and expertise to provide constitutionally effective legal representation and assistance of counsel on appeal in cases arising in participating counties in which the contractual agreement requires him/her to appear as counsel of record.Once Provider enters an appearance, s/he agrees to provide effective, timely, and continuing Services for indigent individuals appealing criminal convictions, pursuant to the obligations set forth in Utah and Federal law, and this agreement.Once a Provider accepts an appeal, the Providers Appellate Defense Services shall include, but are not limited to:The following activities in a case:Entering an appearance with appellate court;consulting with clients in person, or as practicable, as soon as possible after entering an appearance;Ordering transcripts, requesting the official court record/pleadings, and requesting trial counsels files;Reviewing the court record, pleadings, transcripts, and trial counsels file for appellate issues.
