Specifications include, but are not limited to:3.2.1 DORS intends to solicit bids for a Contractor to provide vehicle conversion/modification services for the specified client of the Division of Rehabilitation Services located, at 2301 Argonne Drive, Baltimore, Maryland 21218.3.2.2 Acceptance shall be determined upon the completion of the installation of all equipment as detailed in the VEAPA, passing inspection of the vehicle with modifications as required, and client accessibility, operation, and acceptance of the modified vehicle.3.2.3 All products purchased from this Contract shall carry the standard Manufacturers one-year warranty from date of delivery.3.2.4 The Contractor may not subcontract any portion of the services provided under this Contract without obtaining the prior written approval of the Procurement Officer, which approval the State may withhold or condition in its sole and absolute subjective discretion. Contractor may not assign this Contract or any of its rights or obligations hereunder, without the prior written approval of the Procurement Officer, which approval the State may withhold or condition in its sole and absolute subjective discretion. Any such subcontract or assignment shall include all the terms of the Contract and any other terms and conditions that the State deems necessary to protect its interests. The State shall not be responsible for the fulfillment of the Contractors obligations to the subcontractors.Time is an essential element of the contract, and it is important that the work be vigorously prosecuted until completion. For each day that any work shall remain uncompleted beyond the times(s) specified elsewhere in the contract, solicitation or proposal, the Contractor shall be liable for liquidated damages in the amount of one (1) percent of the contract price, per day, not to exceed twenty (20) percent of the contract price. Due account shall be taken for any adjustment in specified completion time(s) for work as granted by approved change orders.The successful Contractor shall be responsible for all materials and services required by this IFB.3.2.7 Damages will not be assessed for delays or non-performance where performance of the Contractor's obligations is prevented or delayed by natural disasters, freight embargoes, strikes, fire or acts of God, provided the Contractor notifies the State's contract administrator and/or project manager of such circumstances and the State's contract administrator/project manager reasonably determines that the failure to perform within the specified time was beyond the control and without fault or negligence of the Contractor.
