Specifications include, but are not limited to:. This is a Statewide Agreement in which the Contractor shall provide Portable DiagnosticSleep Testing Services (PDSTS), on an as-needed basis, to Patients/Youths referred forsuch medical services from the California Department of Corrections and Rehabilitation(CDCR) and the Division of Juvenile Justice (DJJ). Contractor shall provide all labor,materials, staff, transportation, license, permits and every other item of expense necessary,unless otherwise stated. Services shall be provided on-site upon request and under thedirection of the Chief Executive Officer, Chief Medical Executive, and Facilitys ChiefMedical Officer (CEO/CME/CMO) or designee. For purposes of this Agreement the CDCRdesignee must be a civil service employee. The CEO/CME/CMO or designee retainsprofessional and administrative responsibility for services rendered.B. Contractor must be able to perform the tasks associated with providing medical services asnoted in the heading under the scope of their license. Contractor must possess all PortableDiagnostic Sleep Testing equipment and must be able to provide diagnostic analysis.Under no circumstances can any portion of this medical service be subcontracted.Subcontracting shall be cause for termination of the Agreement. Contractor will berequired to render health services as stated below and as required by law on an as neededbasis. Contractor will perform services in accordance with federal and state laws andregulations and CDCR policies and procedures and shall at all times comply with universalsafety precautions and maintain CDCR security measures and a safe work environment.C. Contractor agrees that, unless otherwise stated, all expenses associated with travel to andfrom the Institution/Facility, lodging, and all training expenses for services shall be borne bythe Contractor and will not be reimbursed separately by CDCR/DJJ. Any and all servicesperformed outside the scope of this Agreement will be at the sole risk and expense of theContractor.D. Contractor acknowledges that CDCR is not obligated to provide or pay for Patient/Youthhealth care services or treatment beyond those which are essential to prevent death, orpermanent and/or severe disability. If health care service or treatment is non-essential orcould safely be deferred until the Patient/Youth is released from custody, when he/she isable to arrange for services for him/her, CDCR/DJJ shall defer services. Prior authorizationmust be obtained and documented in the Patients/Youths health record for those excludedhealth care services or treatments listed in California Correctional Health Care Services(CCHCS) Medical Standards of Care and National Standards for the service provided underthis Agreement.
