Specifications include, but are not limited to:The Board intends to contract with a vendor for the provision of meeting room space in NewYork City for the New York State bar examination.The Board has established New York, New York as a testing location for the bar examination forthe following reasons: the Board must offer the examination in the Fourth Judicial District; candidateswho test in the Fourth Judicial District usually travel from other states and countries and the testinglocation must be in close proximity to an international airport and to affordable overnightaccommodations; and the Board has invested considerable time and resources into recruiting andtraining a pool of hundreds of examination proctors who live in New York, New York, and the testinglocation must be within an easy commute for them.The Board has established the need for one large testing facility given the logistics of offering atwo day exam to thousands of candidates. For example, the Board must: make sure each test locationhas flexible space that can meet the actual demand for candidates, including laptop accessible seats;make arrangements to have thousands of tables and chairs set up in a classroom style in each location;coordinate delivery and pickup of truckloads of secure, paper examination materials; distributeexamination materials on the days of the examination to each test location; and have materialsdistributed to each candidate and seat candidates for a 9:00AM or 9:30AM start time. These logisticsdemand that testing is done in as few locations as possible. The more the exam is spread out, the moredifficult it becomes to communicate when problems arise, maintain secure and comparable testingenvironments, and timely distribute examination materials. More facilities usually results in an increasein costs.The Board has also established the need for a consistent test facility from exam to exam. TheBoard must hold the examination twice each year, and contracting with multiple venues each year isinefficient. It is also critical for planning purposes for the Board to know where it will be testing andhow many seats will be available. The Board is competing with other organizations for meeting room pace and has incurred additional expense when preferred facilities are not available. Finally, aconsistent test location is critical administratively in that: the Board relies on an armored currier todeliver and pickup examination materials who must be familiar with the location in order to ensuretimely delivery; security personnel must be familiar with the facility in order to provide a sound securityplan for the examination; and staff and proctors must be familiar with the facility in order to assistcandidates during the exam.
