Specifications include, but are not limited to:The following definitions pertain to the Lien Enforcement services required: Definitions Lien Enforcement services (including unlawful detainer and forbearance) shall mean those services which facilitate legal activities and proceedings that recover possession of real property / remove a tenant from that property, defer date of trustee sale through an agreement with time certain and any other activities used to facilitate recovery of debt and/or security of property. Required Services Vendor shall ensure all materials and documents are delivered to the County of Fresno, Department of Public Works and Planning, Community Development Division, located in the County Plaza Building at 2220 Tulare Street, 6th Floor, Fresno, CA 93721, unless otherwise indicated. Vendor shall submit a statement or other documentation demonstrating that they have sufficient staffing and expertise to provide all services specified. The pricing structure for the contract shall be the amounts listed on the Quotation Schedule, as provided by the successful bidder for services. Quantities: Estimated 6 lien enforcement cases per year. The following items are a list of included lien enforcement services that may be required as a result of foreclosure: 3-Day Notices To Quit shall be served within 5 days of County request 30-Day Notices To Quit shall be served within 5 days of County request 90-Day Notices To Quit shall be served within 5 days of County request If tenant does not vacate, Unlawful Detainer Complaint shall be filed in Superior Court after time specified in the Termination Notice. County shall be notified of Unlawful Detainer court date. In all cases, the court will be requested to sign a Writ of Possession. Tenant will be served with the Unlawful Detainer Complaint personally, by mail, or by posting on property within 5 days of the filing of Complaint. Tenant will be allowed 5 days to submit an answer to the court after service of process. Case will be set for trial, if defendant files an answer, within 20 days from date of request. Receive default judgment, if defendant does not answer complaint
