Specifications include, but are not limited to:The Department is issuing this solicitation to ensure that indigent and/or alleged disabled adults are afforded all of the rights, entitlements and protections as defined under Maryland State law, via legal representation. Pursuant to the Annotated Code of Maryland, Estates and Trusts Article, 13-705 and 709, or Family Law Article, 14-404 in which either DHR or the Department of Aging is involved in adult guardianships or protective services, MLSP is required to provide legal representation to vulnerable adults.MLSP manages all such legal services Contracts Statewide and is charged with ensuring that indigent and/or alleged disabled adults involved in the Adult Public Guardianship system receive quality legal representation for the duration of their time of need. In Fiscal Year 2015, MLSP Contractors represented Clients in over 1,759 APS Guardianship hearings and APGRB proceedings Statewide. Each year the number of hearings is expected to increase in correlation with aging trends across the State (see APS/APGRB Projected Caseloads Attachment BB).3.2 SCOPE OF WORK - REQUIREMENTS3.2.1 General RequirementsContractors are appointed to cases by the Circuit Court of each Maryland Jurisdiction. Such appointments may occur on a daily basis. New cases coming before the Circuit Court are filed by the various LDSS offices.The Contractor shall: Provide sufficient qualified staff to meet the requirements of this RFP and provide APS/APGRB legal representation services. The Contractor shall identify its staff using the Projected Staffing Form (Attachment R). Ensure that each attorney providing legal representation under this Contract does not exceed a 1:150 Attorney-Client ratio. Deliver legal services to indigent and/or alleged disabled adults and zealously advocate for the needs of each Client. Dedicate a minimum of six (6) hours per case annually (see Section 3.2.10) to each Client. The six (6) hour minimum is based upon a reasonable estimate of the minimum amount of time that the attorney can anticipate spending annually to prepare for and/or represent a Client involved in an APS/APGRB case. Not be permitted to seek payment through Client assets once an invoice has been submitted to MLSP (see Section 3.6.3(d) for exceptions). Utilize the MLSP electronic invoicing system for invoicing and billing. The system is web-based and will be available 24 hours a day, 7 days a week and is functional on the following web browsers:Internet Explorer (IE) Version 11 and greaterChrome version 47.0.2526111m and greater
