Specifications include, but are not limited to:Owner is seeking written proposals from highly qualified firms with significant technical expertise in the Federal Energy Policy Act of 2005 to provide comprehensive services that will enable Owner and its component universities to maximize deductions and savings allowable under the Energy Policy Act according to the Tasks identified below. The successful Respondent will act as the Energy Policy Act Coordinator and should have experience providing savings related to Section 179D to governmental agencies, particularly multi-campus public universities. All activities of the selected Respondent shall be performed at the direction of the University of Houston System Office of Facilities Planning and Construction in coordination with other University of Houston System offices and resources.Task 1--Evaluate Owners Projects for Eligibility. Selected firm(s) will assist Owner to maximize tax savings under the Energy Policy Act of 2005. These services are expected to include, but are not limited to:Prioritize older projects from 2011 forward; determine the retroactive extent of tax deductions available to the Designers of constructions or renovation/modernizations of applicable Owner buildings and projects.Determine the prospective extent of the tax deduction in the Energy Policy Act of 2005 available to the Designers of construction or renovation/modernization of applicable Owner buildings and projects.Provide or cause to be provided appropriate level of expertise required in the Energy Policy Act of 2005 in each area (e.g. Professional Engineer, Tax Consultant, etc.) needed to comply with the provisions of the Act.Contact and inform the Designers of the possible tax deduction and obtain commitment letters.Negotiate, as directed by Owner, agreements with the project Designers to maximize payment to Owner in return for its assignment of the tax deductions to the Designer.Alternatively, negotiate, as directed by Owner, agreements to maximize the benefit to Owner by reducing respective project costs to the extent allowed under the Energy Policy Act in return for Owners assignment of the tax deduction to the Designer.Provide a recovery strategy and probability assessment for Owner to monetize prior deductions deemed technically closed due to inadvertent waiver, express or implied or that fell below a threshold of recovery. In collaboration with Owner, pursue prior opportunities and provide Owner a list of those projects that fall below recovery thresholds. Assist Owners staff to understand the threshold determinations and the efforts required to pursue such claims.Produce and provide to appropriate governmental agencies all supporting documentation to achieve certification.Provide documentation of errors and omissions insurance or similar insurance policy to protect against or mitigate disallowance risk.Task 2Administer Rebates for Eligible Owner ProjectsAssist Owner in supplying all supporting documentation required by the Energy Policy Act, and implementing the rules and regulations prescribed by the IRS to achieve tax deductibility.
