Specifications include, but are not limited to:The contractor will conduct and complete three studies with three final reports, (1) the Drug FormularyImplementation Plan and Design, (2) Economic Analysis for the Californias Drug FormularyRegulations, and (3) Status of the Creation of the Formulary and the Monitoring Plan.The objective of first study, Californias Drug Formulary Regulations: Implementation Plan, includes,but is not limited to the following requirements:A. Design an evidence based drug formulary for the California Workers Compensation Systembased upon the following characteristics:i. The Formulary is based upon scientific evidence to determine which drugsfacilitate optimal health and reduce adverse impacts and disabilityii. The analysis will use accepted methodologies across jurisdictions6iii. The scientific assessment and analysis must be separate from the cost analysisiv. The Formulary must prioritizes successful patient outcomesB. Recommend an implementation plan for the new drug formulary that includes:i. The structure of the formularyii. The process used to make formulary decisionsiii. The rules for dispensing the formulary including the integration with the medicaltreatment guidelines, independent medical review processes, medical fee schedules,Medi-Cal, and any other relevant cost structures.iv. The specific conflict of interest language and detailed protocol that must govern thepharmacy and therapeutics committee charged with making prescription drug coveragedecisions based on scientific evidence and standards of practice for the workerscompensation drug formulary. Such language and protocol shall meet the requirementsof California Labor Code section 5307.29(c)(2), and set a standard at least as stringent asthe conflict of interest requirements provided in federal regulations governing Medicaidand Medicare drug formularies, found at Chapter 42 of the Code of Federal Regulations,Parts 422 and 423. Further, Contractor shall discuss how its proposed conflict ofinterest language and protocol address the criticisms of federal conflict of interestregulations governing Medicaid and Medicare drug formularies detailed by the Office ofthe Inspector General in its March 2013 report, Gaps in Oversight of Conflicts ofInterest in Medicare Prescription Drug Decisions.
