Specifications include, but are not limited to:The Department anticipates the need for one or more attorneys to serve as independent fact finders to consider the stated basis of neighborhood organization or public opposition to a development, should such opposition be challenged. The fact finder would: a.develop an understanding of the precise nature of the opposition; b.be able to determine if there were a governmental or quasi-governmental cognizant body that would have authority to make factual determinations having a bearing on the same issues as those forming the basis for opposition; c.determine if any such factual determinations had, expressly or implicitly, been made; d.determine whether the neighborhood organization or public opposition was consistent or inconsistent with any such determinations; and e.plan to process and complete final reports for 5 to 15 QCP challenges between May 15thand June 15th. The exact number of QCP challenges and the time period for completing and submitting the reports is subject to adjustment based on the actual number of challenges received and the Board meeting schedule. Challenges to public opposition on applications for 4% credits are less predictable as to when they might occur and would likely be substantially fewer in number. 2.An ideal Respondent will have prior experience as a fact finder but will also have prior experience with matters likely to have a bearing on issues related to multifamily development such as familiarity with zoning boards, land use planners, and other matters likely to raise significant budgetary concerns such as emergency response, crime response, traffic, environmental concerns, and foreseeable burdens on local schools. Also, an ideal Respondent will have familiarity with the precepts of the Fair Housing Act.
